Doctors warned against sex with ex-patients

In the United States, most people believe that Health Insurance Portability and Accountability Act HIPAA laws keep our medical records private, shared only amongst our doctors, ourselves, and maybe a loved one or caregiver. In fact, there are dozens of individuals and organizations that are legally allowed to access our medical records for a variety of reasons, either by request or by purchase. In some cases, we provide permission for their access.

In others, permission isn’t necessary. In still other cases, we provide permission without even realizing we’ve done so. And then there are those who access our records illegally.

In Re a Psychologist [] TASSC 70 , the Supreme Court of Tasmania quashed a decision of the Psychologists Registration Board of Tasmania to suspend a psychologist for 6 months for entering into a sexual relationship with a former patient fewer than 2 years after the end of the therapeutic relationship. In fact he married her. A couple of newspaper articles are here and here. Also because the reasons were inadequate.

Justice Blow engaged in a mini-review of recent cases about health professionals and sex with former patients:. The appropriate test must be whether a sexual relationship would exploit the client or put the health of the client at risk. This is particularly so where transference may still operate so as to induce the client to seek the intimacy. It seems to me that consent in these circumstances cannot be an answer to an allegation of misconduct.

The medical profession does not have a firm rule prohibiting all sexual relationships with former patients, nor does it have anything like the inflexible two-year rule now applicable to psychologists. I know of no other profession that has such a rule, and I suspect that only the priesthood has a stricter rule. Normally, the doctor and patient relationships should be terminated. Each case must be considered on its merits.

The considerations referred to in paragraph 9 will again be relevant.

The public is being asked whether doctors should be able to have sexual relationships with ex-patients without fear of reproach. The guidance sets out boundaries The General Medical Council, the body that regulates doctors, wants to gauge public opinion before updating its advice to doctors. Currently, it strongly advises doctors against dating patients.

But its new draft acknowledges that a blanket ban is too strong. It wants to strike a balance between protecting vulnerable patients from abuse and giving doctors autonomy.

5. Guidance on maintaining sexual boundaries with former patients.

Doctors should not pursue sexual relationships with their former patients in most cases, the profession’s watchdog warned today. New good practice guidance issued by the General Medical Council GMC states that it is usually inappropriate for doctors to have sex with an ex-patient because of the risk this may involve of an abuse of their former professional relationship.

But the guidance, revised in the wake of scandals such as the Harold Shipman murders, does not impose a ban on doctors dating their former patients. Instead the GMC, which regulates all the UK’s doctors, advises doctors to weigh up several factors before deciding whether or not to have sex with an ex-patient. These are: when the professional relationship ended and how long it lasted; the nature of that relationship; whether the patient was particularly vulnerable at the time for example suffering from a mental illness and whether they still are; and whether they are likely to care for relatives of the ex-patient in the future.

The guidance states: “If circumstances arise in which social contact with a former patient leads to the possibility of a sexual relationship beginning, you must use your professional judgment and give careful consideration to the nature and circumstances of the relationship. Doctors are also warned not to use their professional relationship with a patient as a means of pursuing a sexual relationship with someone close to them.

The advice states: “For example, you must not use home visits to pursue a relationship with a member of a patient’s family. If a doctor is unsure whether pursuing a relationship with an ex-patient or someone close to them amounts to – or could be seen as – an abuse of their profession, the GMC advises them to discuss the situation with a colleague or a medical body such as itself.

The former University of Southern California gynecologist who was arrested in June and has been accused of sexually abusing patients, surrendered his medical license last week, the California Medical Board announced Monday. George Tyndall was charged by the Los Angeles County district attorney’s office with committing 29 criminal felonies while treating student patients at the university health center from to The decision to voluntarily give up his medical license — which was already set to expire on Jan.

The board’s accusation details five instances of alleged misconduct; accounts of examinations with young women during which Tyndall digitally penetrated them, conducted exams without a chaperone present, told women to disrobe and remained in the room while they removed their clothes and made racially insensitive and sexist comments. When the doctor–patient relationship turns sexual. Went out his way to somehow get the nurse patient. That’s a major NO in my book. He’ll be just as “persistent”.

The dynamic between patient and physician is in the midst of massive transformation, shifting as rapidly as the health systems surrounding it. This surpasses generational expectations, and is as much sociologic as it is ideologic and systematic. New pathways to care, including telemedicine, urgent and retail clinics, impact how patients view their personal connection with any one given physician. Expansion of healthcare teams to include social workers, care coordinators and others alters the one-on-one dynamic and obscures the days of the solo family doctor or heroic surgeon.

With the exception of areas of innovation such as direct primary care, it is yet to be discerned what number of different team members that a patient will accept before the sanctity of the individual relationship is lost. Healthcare systems have done a poor job of communicating expectations and rationale for new pathways to care. The role of technology within the patient-physicians dynamic remains in flux, ill-defined, and inconsistent.

Both patients and physicians are left with underlying confusion and uncertainty as they attempt to apply antiquated frameworks to navigate the modern healthcare environment. Technology has revolutionized how patients interact with their own health as well as the structure of individual episodes of care. Clinicians access up-to-date resources at the click of a mouse. Computers and cell phones distract eyes and ears, often making listening a luxury for both parties.

I am astounded by the number of patients who express guilt and sheepish admissions that they have researched their symptoms online. I regularly encourage my patients to explore and understand their own health. I believe the past role of the physician as sole purveyor of knowledge is outmoded.

FOX 2 – A former Henry Ford doctor is accused of sexually assaulting women and the health system is accused of not doing enough to protect them. The incidents have been described as four very disturbing cases of sexual abuse by the pain management doctor, dating back to at least The allegations are that Dr. Vivek Loomba -a physician out of West Bloomfield, touched a woman’s breasts and buttocks during a doctor’s office visit.

The terms medical record , health record , and medical chart are used somewhat interchangeably to describe the systematic documentation of a single patient ‘s medical history and care across time within one particular health care provider’s jurisdiction. The maintenance of complete and accurate medical records is a requirement of health care providers and is generally enforced as a licensing or certification prerequisite.

The terms are used for the written paper notes , physical image films and digital records that exist for each individual patient and for the body of information found therein. Medical records have traditionally been compiled and maintained by health care providers, but advances in online data storage have led to the development of personal health records PHR that are maintained by patients themselves, often on third-party websites. In , Congress authorized and funded legislation known as the Health Information Technology for Economic and Clinical Health Act [5] to stimulate the conversion of paper medical records into electronic charts.

While many hospitals and doctor’s offices have since done this successfully, electronic health vendors’ proprietary systems haven’t always been compatible with one another, and an untold number of patients undergo duplicate procedures — or fail to get them at all — because key pieces of their medical history are missing. Because many consider the information in medical records to be sensitive private information covered by expectations of privacy, many ethical and legal issues are implicated in their maintenance, such as third-party access and appropriate storage and disposal.

The information contained in the medical record allows health care providers to determine the patient’s medical history and provide informed care. The medical record serves as the central repository for planning patient care and documenting communication among patient and health care provider and professionals contributing to the patient’s care. An increasing purpose of the medical record is to ensure documentation of compliance with institutional, professional or governmental regulation.

The traditional medical record for inpatient care can include admission notes , on-service notes , progress notes SOAP notes , preoperative notes , operative notes , postoperative notes , procedure notes , delivery notes , postpartum notes , and discharge notes. Personal health records combine many of the above features with portability, thus allowing a patient to share medical records across providers and health care systems.

A patient’s individual medical record identifies the patient and contains information regarding the patient’s case history at a particular provider.
